Terms & Conditions

1. General
The following conditions of sale apply to contracts made with Smart Card World, hereinafter called Smart Card World. All quotations are made and orders accepted subject to the following conditions of sale No conditions or terms of the customer shall apply. No addition to or alteration or modification of these conditions of sale shall have effect unless such addition, alteration or modification is expressly accepted by Smart Card World in writing and signed by a duly authorised representative.

2. Acceptance
No contract is concluded until the customer’s order is accepted in writing by Smart Card World. Unless previously withdrawn, or otherwise specified by Smart Card World in writing, quotations (where issued) are open for acceptance within thirty days from the date on which they are made.

3. Information
a) Descriptions, drawings, specifications and other particulars given by Smart Card World in catalogues, price lists and elsewhere are not binding on Smart Card World unless specifically confirmed in writing as being applicable to the goods supplied.
b) Should any information or data supplied by the customer to Smart Card World for the preparation of a quotation prove not to be sufficient or accurate Smart Card World reserves the right to amend the quotation and (where applicable) to make any alteration or amendment in the quoted price to cover any resulting increase in cost.

4. Prices
a) Unless otherwise indicated all prices do not include the cost of delivery within the United Kingdom.
b) The customer shall pay all other duties, charges and taxes (if any) chargeable in respect of the supply of the goods to the customer.
c) Smart Card World reserves the right to vary its prices without notice and unless otherwise expressly specified in the quotation, goods will be supplied and invoiced at the price ruling at the time of despatch.
d) Prices quoted by Smart Card World are for the quantities and on the terms stipulated in the quotation and shall be subject to variation if the quantities or the terms in question are in any way amended.
e) Unless otherwise indicated all prices are quoted exclusive of VAT.
f) Unless otherwise stated export prices do not include freight costs outside the United Kingdom and these will be added to the invoice.

5. Delivery
a) Unless otherwise indicated delivery shall take place at the agreed destination within the United Kingdom except, if the customer collects the goods, delivery shall take place when the goods are loaded on the collection vehicle. In the case of export orders, unless otherwise agreed delivery shall take place at a destination in the United Kingdom appointed by the customer and agreed by Smart Card World.
b) In all cases dates quoted by Smart Card World are subject to confirmation by Smart Card World at the time an order is accepted.
c) Smart Card World will use its best endeavours to deliver the goods promptly or in accordance with the terms stated, but all delivery times or dates (whether confirmed or not) must be treated as estimates only, and Smart Card World shall be under no liability whatsoever for any failure or delay in despatch or delivery nor for any loss or damage whatsoever arising thereat.
d) If the goods are not taken up or delivered by the quoted delivery date by reason of any default of the customer, Smart Card World may either treat the contract as repudiated or alternatively store the goods at the customer’s risk and expense.
e) Where the agreement provides for delivery by instalments each instalment shall constitute a separate contract and any failure or defect in any one or more instalments delivered shall not entitle the customer to repudiate the agreement nor to cancel any subsequent instalments.
f) The customer shall not be entitled to reject the goods by reason only of short delivery.
g) If for any cause whatsoever beyond its control Smart Card World’s normal production of goods required for the performance of the contract with the customer and other comparable contracts is reduced, Smart Card World may proportionally reduce the quantities to be supplied to the customer without incurring liability for any loss or damage thereby suffered by the customer.

6. Settlement Terms
Account holders
a) Liability for payment arises on delivery unless otherwise specified in the quotation or otherwise in writing invoice for goods supplied must be paid within thirty days from the date of the invoice. No deductions are allowed
b) Smart Card World reserves the right to charge interest on overdue accounts at a rate per annum of two percent above HSBC base rate the time payment is due.
c) Payment shall be due whether or not property in the goods has passed by virtue of condition 7 and Smart Card World shall accordingly be entitled to sue for the price once the same is due even if property in the goods has not passed
d) Any default by the customer in making payment on the due date shall entitle Smart Card World (without prejudice to its other rights) to suspend deliveries to the customer
Non-Account holders
Required to pay by credit card before goods will be released.

7. Property and Risk
a) Risk shall pass to the customer on delivery to the appointed destination within the United Kingdom
b) Subject to condition 14 property in the goods will only pass to the customer when all sums owing to Smart Card World (including any interest under clause 6b) under this or any other contract between the customer and Smart Card World have been received in full by Smart Card World and until that date the customer is required to store and mark the goods in such a way that they are readily identified as the property of Smart Card World except that the customer shall be entitles to sell the goods in the ordinary course of its business.
c) On the occurrence of any of the events specified in condition 15 a) or if Smart Card World shall reasonably consider for any reason that its goods are in jeopardy
d) the customer’s authority to sell the goods which belong to Smart Card World shall end and all goods belonging to Smart Card World shall be delivered to Smart Card World (at the customer’s expense) up to the value of the sums owing to Smart Card World from the customer, and ii) Smart Card World by its employees or agents shall be entitled to enter upon or into any land, buildings, vehicles or vessels where the goods are stored to retake possession of those goods which remain the property of Smart Card World up to the value of the sums owing to DD from the customer; and iii) all proceeds of sale of those goods belonging to Smart Card World sold by the customer shall be paid into a separate bank account and held on behalf of Smart Card World. Where the goods are incorporated into another product before being sold to the customer, the customer shall pay into the separate bank account such proportion of the proceeds of sale of that other product as represents the value of the goods belonging to Smart Card World.

8. Inspection, Proofing and Testing
Goods supplied by Smart Card World are submitted to standard inspection and testing before despatch Any additional or special tests which Smart Card World may agree to carry out at the request of the customer may be charged extra.

Printing onto plastic cards uses a di sublimation process and uses RGB and an overlay, printing is normally completed at around 300 dpi and whilst the output is generally acceptable it will not provide the same output quality as printing onto specially treated photo paper and is therefore subject to a minimum 10% variation in colour.  The only exception to this is during a Litho printed process which is uneconomical for short runs due to the high set up costs.  

A match-print colour proof guarantees a reasonable likeness to the final printed pieces. While a match print will accurately predict colour, screen pattern and dot placement, a reasonable variation between the match print and the final printed piece is to be expected. When variations of this kind occur, it will be considered acceptable performance.


Smart Card World does not guarantee colour matching or ink density on repeat or batch runs because of the differences in equipment, card substrates, ribbon cartridges, printer head heat settings and other conditions that may prevail. When variation of this kind occurs, it will be considered acceptable performance.

Customers must provide all colour printing images in RGB format.    Smart Card World is not responsible for any colour shift that occurs in conversions from CMYK to RGB colour modes. Text smaller than ten points created in Photoshop may print in a pixelated or bit-mapped manner. In such instances Smart Card World will not be held liable for bit-mapped text. To avoid this it is best to use programs such as Quark Express or Adobe Illustrator to create text. Ordering a match print proof will predict whether bitmap text is a potential problem.

9. Recommendations
Recommendations regarding the use and/or performance of the goods are based on tests and experience considered to be reliable but as the conditions to which the goods may be subject when in service are beyond the control of Smart Card World, Smart Card World cannot guarantee such performance or results obtained from any such use.

10. Returns Policy
(a) The Company's liability (both in contract and in tort) in respect of defects in the Goods shall be limited to the replacement of faulty items or material, or the issue of credit note in respect thereof, or the granting of a refund or such other compensatory measures as the Company at its discretion considers appropriate in the circumstances. Such measures shall relate only to the actual faulty items or their value, and the Company shall not in any circumstances be under any liability to the Buyer in respect of indirect or consequential loss or damage, or loss of profits, sustained by the Buyer PROVIDED, always that these conditions do not exclude or restrict the Company's liability for death or personal injury arising from its negligence.                                                                                                                 (b) A returns authorisation number must first be obtained from the Company's service department either by telephone or letter. Returned Goods must be accompanied by a copy of the original invoice relating to their purchase.
Goods returned for repair under warranty must be accompanied by a copy of the original invoice, or must quote the original invoice number and date of purchase. Before returning items, please ring the Company's service department for authorisation to return items - a discussion of the problem may assist in rectifying faults before Goods are returned!
It is the Buyer's responsibility to ensure that any Goods returned are properly insured. The Company shall not be responsible for Goods returned that are lost in transit.                       (d) Claims for defects, damages, or shortages must be made by the BUYER in writing no later than TWO BUSINESS DAYS (2) after delivery. If for any reason the order is not acceptable BUYER must return the job no later than Three BUSINESS DAYS (3) for an inspection and reprint if needed. If no such claim and return is made, Smart Card World and the BUYER will understand that the job has been accepted. We maintain the right to judge what a manufacturing error and defect is. By accepting the job, the BUYER acknowledges that Smart Card World performance has fully satisfied all terms, conditions, and specifications.

Smart Card World liability will be limited to the quoted selling price of defective goods, without additional charge for special or consequential damage or as specified. As security for payment of any sum due under the terms of any Contract, Smart Card World has the right to hold and place a lien on all BUYER property in Smart Card World possession. This right applies even if credit has been extended, notes have been accepted, trade acceptances have been made, or payment has been guaranteed. If payment is not made, the BUYER is liable for all collection costs incurred, including a minimum of TWENTY FIVE POUNDS on all returned cheques.
